About us and these terms

Secmont is a sole proprietorship based in Maharashtra, India ("Secmont", "we", "us", "our"). These Terms of Service govern every site inspection, quotation and work order we provide to you ("you", "the client").

By booking an inspection, accepting a quotation or allowing work to begin, you agree to these terms. Where a written quotation or work order states something different, the quotation or work order prevails for that job.

Our services

We provide waterproofing, damp proofing, structural and crack repair, concrete and plaster restoration, exterior weather-shield painting and allied civil work. The exact scope of each job is defined only by the accepted written quotation. Anything not listed in the quotation is outside the scope of work.

Site inspections

1. Site inspections are free and carry no obligation to engage us.
2. Please give our team safe access to the affected areas at the agreed time. If access is not available, we may reschedule.
3. An inspection is a visual and non-destructive assessment. Some defects are concealed inside the structure and cannot be seen until work begins.

Quotations

1. Each quotation is based on the site conditions visible at inspection and the information you give us. It is valid for 30 days from its date.
2. If we discover concealed conditions during work (for example hollow plaster, corroded reinforcement or a hidden plumbing leak), we will stop, show you the issue and agree any change in scope and price in writing before continuing.
3. Measurements in the quotation are estimates. Final billing follows the actual area treated, measured jointly on site where either party asks.
4. Quoted rates hold for 30 days from the quotation and for jobs that start within 30 days of acceptance. If the start is delayed by more than 30 days for reasons on your side, we may revise rates for changes in material prices, with your written agreement before work starts.
5. Where we recommend work that you decide not to take up, we record it on the quotation. We are not responsible for leakage, dampness or damage coming from those areas, now or under the warranty.

Prices, taxes and payment

1. Unless the quotation says otherwise, payment is due as follows: 50% advance on acceptance, 40% when application is complete, and 10% after the water test and handover.
2. Goods and Services Tax (GST) and any other applicable taxes are charged in addition to the quoted price, as shown on our tax invoice. Where GST applies, our GSTIN is printed on the tax invoice.
3. Payments are accepted by bank transfer, UPI or cheque in the name of Secmont or the proprietor. We do not ask for cash payments to individual workers; please do not make them.
4. If a payment is overdue by more than 7 days, we may pause work until it is cleared, and the schedule will be extended accordingly.

Your responsibilities

1. Provide safe access, water and electricity for the duration of the work, and a secure place to store materials on site.
2. Only order work if you own the property or have the authority of its owner and, for common areas, of the housing society.
3. Clear furniture, plants, fixtures and personal belongings from the work area before we start. If you ask us to move items, we take reasonable care, but we are not responsible for damage to items left in the work area unless it is caused by our negligence.
4. Tell us about any known structural problems, previous treatments, concealed pipes or wiring, and any society or building permissions needed.
5. Obtain any approval required from your housing society, landlord or authority before work starts.
6. Keep the treated area free of foot traffic, water and loads for the curing time we advise.

How we carry out the work

1. Work is carried out by our own trained teams under our supervision. Where a specialist is needed, we remain fully responsible for their work.
2. We use branded, manufacturer-approved materials and apply them to the manufacturer's specification.
3. We follow reasonable safety practices on site and leave the work area clean at handover.

Schedule, weather and delays

Start and completion dates are estimates. Waterproofing depends on dry weather and on surfaces drying properly, so rain, high humidity, delayed access, late payments or changes in scope may extend the schedule. We are not responsible for delays caused by events outside our reasonable control, including heavy rain, floods, strikes, shortages of materials, epidemics or government orders.

Changes, cancellation and refunds

1. Changes to the scope must be agreed in writing (WhatsApp or email is acceptable) with the revised price before the changed work is done. Our site staff cannot agree extra work, free work, discounts or price changes; only the proprietor can, in writing. The accepted quotation, any written changes and these terms are the whole agreement for the job.
2. You may cancel an accepted quotation by written notice before work starts. We will refund the advance after deducting the cost of materials already purchased for your job and any mobilisation already incurred, with supporting bills on request.
3. If you cancel after work has started, you pay for the work completed and materials supplied up to the date of cancellation. Any balance of the advance is refunded within 14 days.
4. We may cancel a job if site conditions are unsafe or if payments are not made as agreed. In that case we will refund any amount paid for work not done.

Completion and handover

On completion we water-test the treated area where the system allows, walk you through the work and hand over the site, recording this on a handover report. Please raise any visible defect at handover or within 7 days, and we will put it right. The final payment is due on handover.

If you neither sign the handover report nor send us written reasons within 7 days of our notice that the work is complete, handover is treated as having taken place on the date of that notice, and the final payment falls due.

Water testing

Ponding or flood tests can reveal leaks that already exist elsewhere in the building. Please tell the occupants of the floor below before a test and give us access to check underneath. We test in stages and stop at the first sign of seepage. Water passing through areas outside the agreed scope is not our liability.

Drying out after treatment

Walls, slabs and plaster that were already wet can take several weeks, and in thick walls a few months, to dry after the source of water is sealed. Damp patches, stains, efflorescence or peeling paint that fade during this period are not a failure of the work and are not a reason to withhold payment. Repainting or repairing interiors damaged before our work is not included unless it is listed in the quotation.

Warranty

Eligible works carry a written warranty, issued after full payment. The period and conditions are set out in our Warranty Policy and on the certificate issued for your job.

Liability

1. We are responsible for carrying out the agreed work with reasonable skill and care.
2. To the extent permitted by law, our total liability for any job is limited to the value of that job's contract. We are not liable for indirect or consequential loss, such as loss of rent, business or profit.
3. We are not responsible for defects in parts of the building outside the agreed scope, or for damage caused by pre-existing conditions you did not tell us about.
4. Nothing in these terms limits liability for death or personal injury caused by our negligence, for fraud, or any right you have as a consumer that cannot be excluded by law.

Photographs of the work

We may photograph the site before, during and after the work for our records and to show our work on our website and social media. We will not publish your name, your face or your exact address. If you prefer that we do not publish photos of your property, tell us in writing and we will not.

Disputes and governing law

1. These terms are governed by the laws of India.
2. If a disagreement arises, please contact us first. Both sides will try in good faith to resolve it within 30 days.
3. If it is not resolved, it will be referred to a sole arbitrator appointed by mutual agreement under the Arbitration and Conciliation Act, 1996. The seat of arbitration is Mumbai and the language is English.
4. Subject to the above, the courts at Mumbai have exclusive jurisdiction.
5. Nothing in this clause limits a consumer's right to approach a Consumer Disputes Redressal Commission under the Consumer Protection Act, 2019.

General

If any part of these terms is found unenforceable, the rest remains in force. We may update these terms from time to time; the version in force on the date you accept a quotation applies to that job.
